    Terms and Conditions of Use

    PREAMBLE

    The purpose of these General Conditions of Use (hereinafter the "GCU") is to determine the conditions of access and rules for use of the SNCF Voyageurs website, accessible via the following link: https://sncf-voyageurs.com/ (hereinafter the "Website").  

    Access to the Site is subject to compliance with the GCU and is strictly reserved for the User as defined below.

    The Publisher reserves the right to unilaterally modify or update the GCU at any time, according to changes or additions made, in particular in order to comply with any legal, jurisprudential, editorial and/or technical developments, as well as any modifications to the general terms of use of the Host's services.    

    The User must regularly consult the latest version of the GCU, which is permanently available on the Site.

    ARTICLE 1. DEFINITIONS

    In the GCU, words or expressions beginning with a capital letter, in the singular or plural, shall have the following meaning:

    Site: refers to the site offered by the Publisher on the Internet from the address https://sncf-voyageurs.com/ →.

    Cookie(s): refers to computer files stored on the hard disk of the User's computer or mobile device such as a smartphone or tablet.

    Publisher: refers to SNCF Voyageurs.

    Host: refers to SNCF Connect & Tech.

    Information(s): refers to all information and publications accessible on the Website.

    User(s): refers to any person who has access to the Website, regardless of their location and connection method. 

    ARTICLE 2. PURPOSE OF THE SITE

    The purpose of the Website is to provide Users with information and assistance concerning all the activities, products, services and offers of SNCF Voyageurs.  

    All use of the Site shall be in compliance with the GCU.

    ARTICLE 3. ACCESS AND USE OF THE SITE

    3.1 - Access to the Site   

    Access to the Site is possible from a computer, tablet or smartphone connected to a telecommunications network according to the communication protocols used on the Internet network. 

    The Publisher grants the User the right to consult, use and access the Information on the Site. 
     

    3.2. - Cost of access   

    Access to the Site is free of charge and not subject to subscription. All software and hardware required to use or operate the Site, Internet access or communication costs are the sole responsibility of the User outside the workplace.   

    Each User is entirely responsible for his/her own connection data. In the absence of proof to the contrary, any connection to the Site, or transmission of data using the User's connection data, will be deemed to have been made by the User.

     

    3.3. - Duration of access   

    The User's access to the Site is for an unlimited period, without prejudice to the User's or the Publisher's right to unilaterally terminate access to the Site at any time, without notice, reason or compensation. 

    The User acknowledges that the Publisher may block and/or terminate access to the Site without prior notice and with immediate effect in the event of any breach of statutory provisions and/or the GCU. 
     

    3.4. - Use of the Site   

    The User agrees in particular not to, but not exclusively:  

    • using the Site for commercial purposes, and generally offering products and services for direct or indirect remuneration;  
    • to "resell" or make available to a third party and/or other Users the content of the Site, whether in return for payment or free of charge;  
    • use the Site to send unsolicited advertising or promotional material in any form whatsoever.

    3.5. - Information and functionalities offered  

    The Site provides the User with access to information and assistance concerning all of the SNCF Group's activities, products, services and offers.

    ARTICLE 4. AVAILABILITY OF THE SITE

    The Site is accessible 24 hours a day, 7 days a week, except in cases of force majeure or events beyond the control of the Publisher.  

    The Editor reserves the right to suspend, interrupt or limit, without prior notice, access to all or part of the Site, in particular for maintenance and updating operations necessary for the proper functioning of the Site and related materials, or for any other reason, in particular technical. 

    The Publisher is not bound by any obligation of result concerning the availability of the Site, but only by an obligation of means. The Publisher is in no way responsible for interruptions and the consequences thereof for the User, in particular when the interruptions are caused by the Host for maintenance or other purposes.  

    The User is hereby informed that the Publisher may terminate or modify the features of the Site at any time, without notice and without the User having any recourse against the Publisher.

    ARTICLE 5. SITE HOSTING

    Users are expressly informed that the content published on the Website is hosted and stored on the SNCF Voyageurs server. 

     

    ARTICLE 6. INTELLECTUAL PROPERTY

    In general, the User agrees not to infringe the intellectual property rights (copyright, neighboring rights, sui generis rights of database producers, trademark rights, domain names, etc.) of the Publisher and/or the Host, and/or of any third party.  

    The Editor holds all intellectual property rights to both the structure and content of the Site (text, logos, images, sound elements, software, icons, layout, database, etc.) or has regularly acquired the rights to use the structure and content of the Site, without any limitation. 

    The User is therefore prohibited from copying, reproducing, representing, modifying and/or exploiting, transferring in any way whatsoever and for any purpose whatsoever, all or part of the structure and content of the Site, except with the express prior written authorization of the Publisher.

    Downloading is strictly forbidden, unless expressly authorized by the Publisher. The Publisher and/or any third party concerned may take appropriate action against any abusive downloading.  

    All software downloads offered by the Host on the Site must comply with the Host's terms of use. The User must contact the Publisher prior to any download in order to ascertain whether such software is included among the services subscribed to by the Publisher with the Host.

    The consequences of any damage resulting from downloading by the User without informing the Publisher and/or in breach of the Host's terms of use shall be borne entirely by the User.

    Trademarks and logos reproduced on the Site are registered with the relevant Offices by the companies that own them. Any reproduction of the names or logos, by any means whatsoever, without the prior authorization of the owner concerned, is prohibited.

    Failure to comply with these prohibitions may, in particular, constitute an act of counterfeiting and/or unfair and parasitic competition for which the User may be held civilly and/or criminally liable. 

    ARTICLE 7. COOKIES

    All information relating to cookies is available on the Site under the "Cookies" tab.

     

    Piano Analytics (AT Internet) cookies are exempt from the need to obtain consent, as indicated in CNIL Ruling no. 2020-091, insofar as they are strictly necessary for the proper operation of the site. You may refuse the processing of your personal browsing data by activating this option. Please note that by clicking on the following button, we will no longer be able to measure and improve our sites optimally.

    ARTICLE 8. GUARANTEES/LIABILITY

    The User undertakes, when using the Site, not to contravene the legislative and regulatory provisions in force, the good practices of the Intranet and netiquette, and the GCU. 

    The User is hereby informed that any use of the Site in violation of the provisions of the GCU may give rise to liability, legal proceedings and sanctions.

    The User shall be liable to the Publisher and/or third parties for any material and/or immaterial, direct and/or indirect damage of any nature whatsoever caused by the User and/or his/her employees in the event of non-compliant use of the Site.

    The User indemnifies the Publisher, as well as its parent, sister or affiliated companies, representatives, employees and partners, against all demands, claims and/or actions of any kind resulting from any breach of the said provisions.

    In the event of any dispute arising from a breach of the GTU, the Publisher reserves the right to take action against the User in accordance with article 15 of the GTU on the settlement of disputes, or to summon the User as a third party.

    The User may then be required to compensate, at any time and on first demand, any damage caused to the Publisher and/or third parties resulting from any violation of the GCU. 

    This indemnity covers any damages that may be paid, regardless of their direct or indirect origin, as well as legal fees, expert fees and court costs.  

    The User undertakes to act with diligence in responding to any claim.  

    The Publisher undertakes to take all necessary technical and organizational measures to protect the Information circulating on the Site and to guarantee the security of the personal data it has collected and to prevent their disclosure to unauthorized third parties. 

    However, it is the User's responsibility to take all necessary steps to preserve the confidentiality of information transmitted, and in particular to assign it to private areas. 

    Each User of the Site expressly undertakes: 

    • not to use any software or process intended to copy the Information on the Site without the express prior authorization of the Publisher;  
    • to refrain from using software or devices likely to disrupt the proper operation of the Site, or to take any action likely to impose a disproportionate burden on the Publisher's infrastructures;  
    • not to alter, modify or create derivative works from the Information on the Site without the express prior consent of the Publisher;  
    • not to extract or reuse, including for private purposes, without the Publisher's prior written consent, any substantial or non-substantial part of the content of the databases and archives constituted by the Site;  
    • not to collect information on third parties, including e-mail addresses, for the purpose of sending commercial or equivalent solicitations, or to integrate them into a referencing service or equivalent, whether free or paid, or for the purpose of competitive intelligence;  
    • not to set up systems likely or likely to pirate the Site in whole or in part, or likely to violate the GCU;   
    • to inform the Publisher as soon as he becomes aware of any infringement whatsoever (in particular of the Publisher's intellectual property rights), in particular any illicit or non-contractual use of the Site's Information, regardless of the means of distribution used.   

    The Publisher accepts no liability for any use of its services that does not comply with the GCU.

    ARTICLE 10. NULLITY OF A CLAUSE

    The nullity in whole or in part of one or more provisions of the GTU, under the terms of a legal or regulatory provision or a court decision that has become final, does not entail the nullity of the other provisions or the part of the provision not affected by the nullity.

    ARTICLE 11. APPLICABLE LAW - SETTLEMENT OF DISPUTES

    The GTU are governed by French law.  

    In the event of any dispute relating to the interpretation, validity or performance of the GTU, the User and the Publisher agree to use their best efforts to settle the dispute amicably.  

    In the event that an amicable agreement cannot be reached, any dispute relating to the interpretation or execution of the GTU shall be submitted to the jurisdiction of the Paris courts.
